These Terms of Service ("Terms") govern your access to and use of ScratchVoice ("the Service"), operated by Just Silas Communications ("we", "us", "our"). By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
ScratchVoice is an AI-powered voiceover generation platform that produces synthesised audio based on a proprietary licensed voice clone. The Service is designed exclusively to assist creative professionals in producing scratch, placeholder, and draft-stage voiceovers for use during the internal production process — not as a finished, commercially released product.
This is the most important clause in these Terms. The voice used in ScratchVoice is a proprietary AI clone of a real, named voice talent, licensed exclusively for internal creative workflow use. It is not a production-ready voice and is not licensed for any form of public distribution or commercial release.
Your licence to use generated audio is strictly limited to the following internal purposes:

ScratchVoice maintains detailed logs of all generation activity, including user identity, email address, script content, and timestamp. In cases of suspected misuse, we reserve the right to investigate, suspend accounts without notice, and pursue appropriate legal remedies including claims for damages on behalf of the voice talent.
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate, current, and complete registration information. You may not share your account with others or create multiple accounts to circumvent usage limits. We reserve the right to suspend accounts where abuse is suspected.
The Service operates on a credit-based subscription model. One credit is consumed per successful voiceover generation. The following conditions apply:
We reserve the right to adjust pricing with 30 days' written notice to active subscribers.
You may not submit scripts that contain or promote:
The Service uses automated content moderation to detect and block prohibited content before generation. Attempts to generate blocked content are logged and will result in immediate account suspension without refund.
All rights in the voice clone used by the Service — including the underlying voice recordings, likeness, and AI model — remain the exclusive property of Just Silas Communications and the voice talent. Your use of the Service does not transfer any intellectual property rights to you.
You retain full ownership of the scripts you submit. By submitting a script, you grant us a limited, non-exclusive licence to process it solely for the purpose of fulfilling your generation request.
To the maximum extent permitted by South African law, Just Silas Communications shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including but not limited to loss of revenue, data, business opportunities, or reputation.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that generated audio will meet your specific creative requirements.
Our total aggregate liability for any claim shall not exceed the total amount you paid to us in the three months preceding the event giving rise to the claim.
We reserve the right to suspend or terminate your account at any time, with or without notice, for breach of these Terms or conduct we determine to be harmful to the Service, other users, or the voice talent. Upon termination, your access to the Service and any unused credits will be immediately forfeited. Clauses relating to intellectual property, prohibited use, limitation of liability, and governing law shall survive termination.
We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business practices. We will notify active subscribers of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
These Terms are governed exclusively by the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
